IMPORTANT INFORMATION regarding the work of ICAC and UMAC of Ukraine during the martial law regime

Dear users of ICAC and UMAC services and other interested persons!

ICAC and UMAC, under martial law, have resumed accepting claims, as well as other procedural documents relating to the competence of arbitral institutions, and are processing all incoming correspondence online and, where possible, directly. The ICAC and UMAC secretariats maintain correspondence with case-specific arbitral tribunals, disputing parties and other service users by electronic means and, where possible, by postal means.

Given the current situation, all documents and other materials should be submitted electronically to the relevant e-mail addresses of ICAC icac@icac.org.ua and UMAC ddo@macom.org.ua. In addition, the most important procedural documents (claims, responses to the claim, etc.) should also be sent by all types of mail or in person to the reception of the Chamber of Commerce and Industry of Ukraine at the address: Ukraine, 01601, Kyiv, str. Velika Zhytomyrska, 33.

Decisions on applications and motions related to procedural terms, in particular regarding postponement of the payment of the arbitration fee, extension of the deadline for submission of response and additional documents, etc., will be made in each case individually, taking into account the specific circumstances of the case.

Payment of registration and arbitration fees is carried out without prior invoicing of ICAC and UMAC according to the details indicated on the websites of ICAC and UMAC.

ICAC and UMAC are taking all possible measures to resume the administration of current cases and open new ones, including the resumption of proceedings in cases that were suspended in connection with the introduction of martial law in Ukraine. In order to organize the arbitration process, the ICAC and UMAC Chairman appealed to all ICAC and UMAC arbitrators and, above all, to the arbitration panels in specific cases, with a request to communicate with the representatives of the parties and take other measures for the operational organization and completion of the arbitration proceedings.

Until the elimination of circumstances that, in the conditions of military aggression against Ukraine, cause a threat to the life, health and safety of the participants in the arbitration process and arbitrators, oral hearings of cases are carried out using video conference communication systems.

We also draw your attention to the fact that the time during which the martial law regime will operate in Ukraine will not be included in the general term of the arbitration proceedings, established by Articles 38 of the ICAC and UMAC Regulations.
